SURILI VIRASAT FELLOWSHIP PROGRAM

These Terms & Conditions (“Terms”) govern the fellowship, participation, and engagement in Surili Virasat, an initiative of Surili Ahmedabad Music Club Pvt. Ltd. By applying for or accepting fellowship, the Fellow agrees to be bound by these Terms.

By accessing, registering for, installing, or using the Services, you expressly acknowledge, understand, and irrevocably agree to be bound by the provisions of this Agreement. If you do not accept these Terms and Conditions in full, you must immediately discontinue the use of the Services.

DEFINITIONS

For the purposes of this Agreement, unless repugnant to the context, the following terms shall have the meanings ascribed below:

FELLOWSHIP VALIDITY

Fellowship shall be valid for a fixed period of twelve (12) consecutive months commencing from the date of activation (“Activation Date”). The Fellowship shall automatically expire upon completion of the said period unless renewed in accordance with the renewal policy prevailing at that time. Fellowship shall not renew automatically unless expressly offered by Surili Virasat and accepted by the Fellow upon payment of applicable renewal fees.

Fellowship shall be deemed activated only upon fulfillment of all prescribed conditions, including receipt of the full Fellowship Fee without any outstanding dues, successful realization and clearance of payment in the Company’s bank account (where applicable), issuance of an official payment receipt by Surili Virasat, completion of the registration process with submission of required personal details, allotment of a unique Fellowship Number, and formal confirmation of activation communicated through the registered contact details via WhatsApp, Email, or SMS. Mere submission of an application form or payment shall not confer Fellowship rights unless formally activated as stated herein.

In the event of dishonor of cheque, payment failure, transaction reversal, chargeback, or any other unsuccessful payment event, the Fellowship shall be treated as void ab initio unless the outstanding amount is cleared within the time period specified by Surili Virasat. Surili Virasat reserves the right to withhold activation or suspend benefits until full payment realization.

All Fellowship benefits, including access to auditorium and virtual events, shall commence strictly from the Activation Date. Events conducted prior to activation shall not form part of the Fellow’s entitlement. No pro-rata adjustment, partial extension, or compensation shall be granted for delays caused by incomplete documentation, payment issues, or any other reason attributable to the Fellow.

Fellowship validity shall not be extended due to non-attendance, personal commitments, travel, medical reasons, failure to review communications, or any circumstance beyond the reasonable control of Surili Virasat. Any extension, if granted, shall be solely at the discretion of Surili Virasat and shall not create any precedent or obligation for future cases.

Surili Virasat further reserves the right to temporarily suspend Fellowship benefits in cases of breach of Terms & Conditions, misconduct, regulatory requirements, or pending verification of payment or documentation. Such suspension shall not automatically entitle the Fellow to an extension of the Validity Period unless expressly approved in writing.

Fellows may apply for renewal prior to expiry of the Fellowship period, subject to payment of applicable fees and compliance with prevailing policies. Acceptance of renewal applications shall remain at the sole discretion of Surili Virasat.

FELLOWSHIP ENTITLEMENTS

Fellowship includes: Six (6) Auditorium Live Shows, Three (3) Virtual / Online Shows during the Validity Period.

Surili Virasat reserves the right to modify event dates, artists, venues, formats, or schedules due to operational or unforeseen reasons.

No guarantee is made regarding specific artists, repertoire, or performance duration.

Admission to events shall be subject to seating capacity and event-specific guidelines. Surili Virasat reserves the right to allocate seats on a first-confirmed or category-based basis, and seating preference or specific seat allocation shall not be guaranteed unless expressly committed in writing.

Seats shall be allocated as per the applicable fellowship category / zone. Details of the seat selection process shall be communicated to fellows prior to each event. Surili Virasat reserves the right to modify or revise the seat selection policy for any event at its sole discretion, and such modifications shall be binding on all fellows.

Fellowship entitlements are personal to the registered Fellow and cannot be shared, split, or partially utilized across multiple individuals, except as permitted under the Transfer Policy specified in Clause 6. Unused event entitlements within the Validity Period shall lapse automatically upon expiry without any carry-forward, credit, or monetary compensation.

VENUES

Auditorium shows shall be conducted at venues including but not limited to: Pandit Dindayal Upadhyay Auditorium, Tagore Hall, Shela Auditorium, or any equivalent venue as decided by Surili Virasat. Venue selection shall be at the sole discretion of Surili Virasat. The venue may vary from event to event. Surili Virasat reserves the right to change, substitute, or relocate the venue of any scheduled event due to operational requirements, government directives, venue availability constraints, safety considerations, or any circumstances beyond its reasonable control. Such change shall not constitute a breach of Fellowship obligations.

PAYMENT TERMS

Fellowship fees must be paid in advance. Accepted payment modes: Online transfer/payment gateway, Cheque or Demand Draft in favor of Surili Ahmedabad Music Club Pvt. Ltd.

Fellowship benefits commence only after successful realization of payment. Surili Virasat reserves the right to revise fellowship fees for future cycles.

In case of delayed payment, dishonor of cheque, failed transaction, or chargeback, Surili Virasat reserves the right to withhold or suspend Fellowship benefits until full payment is realized, without any liability for missed events or services.

All payments made are non-transferable, non-adjustable, and non-refundable, except in the case of full fellowship cancellation as expressly permitted under the Refund & Transfer Policy (Clause 6). Missed shows, unattended events, or partially utilized fellowship periods are strictly non-refundable. Fellowship transfer is permitted only once during the Validity Period, subject to prior written approval. Fellows are responsible for ensuring accurate payment details and timely remittance.

REFUND & TRANSFER POLICY

Fellowship is refundable only in case of full fellowship cancellation, subject to internal application review and written approval.

Missed shows, unattended events, or partially utilized fellowship periods are strictly non-refundable.

Partial refunds for unused events or partial fellowship periods shall not be permitted unless expressly approved in exceptional circumstances. Any approved refund shall be subject to administrative charges or deductions as per internal policy.

Fellowship may be transferred only once during the Validity Period, subject to a written request and prior approval.

Refund processing timelines, applicable deductions, and administrative charges shall be determined as per internal policy.

All requests for refund or transfer must be submitted in writing through official communication channels. Surili Virasat reserves the right to approve or reject any request at its sole discretion and may require supporting documentation to process such requests.

EVENT ACCESS & ENTRY

Entry Pass / QR Code will be issued prior to each event and shared on the registered mobile number. Entry shall be permitted only upon valid QR Code verification. Surili Virasat reserves the right to deny entry in case of: Misconduct, Non-compliance with event rules, Invalid or duplicated entry passes.

FELLOW COMMUNICATION

All official communication shall be sent via: WhatsApp, email, SMS to the registered contact details. Fellows are responsible for updating their contact information.

OPTIONAL SERVICES

Paid pick-up and drop facility may be offered subject to: Prior booking, Availability and Additional charges. Fellow care services may include: Wheelchair assistance, Basic first aid, Doctor availability at venue, Washroom assistance for senior fellows. Such services are subject to venue facilities and availability.

FELLOW CONDUCT

Fellows shall maintain decorum and respectful behavior during all events. The following are strictly prohibited without prior written permission: Video recording, Live streaming, Professional photography, Use of professional cameras or recording devices. Violation may result in removal from event and/or termination of fellowship without refund.

INTELLECTUAL PROPERTY

All performances, branding, content, designs, recordings, and creative materials remain the intellectual property of Surili Virasat and/or respective artists. Unauthorized reproduction or distribution is strictly prohibited. Fellows are granted a limited, non-exclusive, non-transferable, and revocable right to access and view content strictly for personal, non-commercial use during the Validity Period. Any use beyond this scope, including sharing, copying, reproducing, distributing, public display, or modification, is strictly prohibited without prior written permission from Surili Virasat or the respective rights holder. All digital content, including virtual show streams, downloadable materials, and recordings, are protected under copyright and related laws. Fellows shall not attempt to circumvent digital rights management (DRM) mechanisms or access content through unauthorized channels. Surili Virasat reserves the right to enforce its intellectual property rights through legal means, including but not limited to civil, criminal, or administrative actions, in case of infringement, misuse, or unauthorized exploitation of its content or assets.

VIRTUAL EVENTS DISCLAIMER

In case of technical or unforeseen issues affecting virtual events, the event shall be rescheduled. Surili Virasat shall not be liable for: Internet connectivity issues at Fellow’s end, Device compatibility problems and Power outages. Fellows are responsible for ensuring that their devices, software, internet connectivity, and other technical requirements meet the minimum specifications necessary to access virtual events. Surili Virasat shall not provide technical support for personal devices or network issues beyond guidance for accessing the event. Fellows shall not record, reproduce, stream, or distribute virtual events in any form without explicit written permission. Unauthorized sharing of virtual event content constitutes infringement of intellectual property rights and may result in termination of fellowship and legal action. In the event of rescheduling, Surili Virasat shall make reasonable efforts to notify Fellows through registered contact channels (WhatsApp, Email, SMS). Fellows are responsible for monitoring official communications to access updated schedules.

LIABILITY DISCLAIMER

Surili Virasat shall not be responsible for any: Loss, Theft, Damage to personal belongings, Vehicle damage or theft. Fellows attend events at their own risk. Fellows acknowledge and accept that participation in any auditorium or virtual events may involve inherent risks, including but not limited to slips, trips, falls, or other accidents. Surili Virasat shall not be liable for any personal injury, illness, or health-related incidents occurring during or as a result of attending events. Fellows are solely responsible for the security of their personal belongings, including wallets, mobile devices, bags, and valuables. Surili Virasat shall not provide insurance or compensation for loss, theft, or damage to any personal property. Surili Virasat shall not be liable for delays, cancellations, or changes in event schedules caused by external factors such as traffic, public transport disruption, adverse weather, government directives, or Force Majeure events.

Force Majeure

Surili Virasat shall not be liable for any event beyond the party's reasonable control, such as lightning, flood, exceptionally severe weather, fire, explosion, war, civil disorder, industrial disputes, epidemic or pandemic (whether or not involving employees of either party), acts of local or central government or other competent authorities, then neither party shall be liable for a breach of this Agreement to the extent caused by or arising from any force majeure event beyond the control of such party.

TERMINATION OF FELLOWSHIP

Surili Virasat reserves the right to suspend or terminate fellowship in case of: Breach of Terms, Misconduct, Fraudulent activity, Reputational harm to the organization. Termination under this clause may result in forfeiture of remaining benefits.

Waiver

Unless otherwise expressly stated, the failure to exercise or delay in exercising a right or remedy under this Terms shall not constitute a waiver of the right or remedy or a waiver of any other rights or remedies, and no single or partial exercise of any right or remedy under this Terms shall prevent any further exercise of the right or remedy or the exercise of any other right or remedy.

GOVERNING LAW & DISPUTE RESOLUTION

This Agreement shall be governed by and construed in accordance with the laws of India. Any disputes or disagreements arising out of or relating to this Agreement shall first be attempted to be resolved amicably between the parties through good-faith discussions.

If the parties are unable to reach an amicable resolution within a reasonable period, the dispute shall be submitted exclusively to the courts of Ahmedabad, Gujarat, India, which shall have sole jurisdiction over such matters.

AMENDMENT OF TERMS

Surili Virasat reserves the right to modify these Terms at any time. Updated Terms shall be communicated through official channels and shall be binding upon Fellows.

ENTIRE AGREEMENT AND SEVERABILITY

Entire Agreement: This Agreement, including all policies incorporated by reference, constitutes the entire understanding between the parties. Any prior agreements or communications between the parties regarding the subject matter hereof are superseded by this Agreement.

Severability: If any provision of this Agreement is found to be unlawful, void, or unenforceable, such provision shall be severed from the Agreement, and the remaining provisions shall continue in full force and effect.

All fellowship-related rights, decisions, interpretations, and final authority shall remain solely with Surili Virasat.
